These Terms and Conditions govern the sale of goods and any associated services by Haus of Marble Ltd (“Haus of Marble”, “we”, “us”, “our”). By placing an order, you agree to be bound by these Terms, which form a legally binding contract between you and us. Your statutory rights remain unaffected.
1. Definitions
“Goods” means any products supplied by Haus of Marble, including but not limited to marble bathtubs, kitchens, cabinetry, worktops, vanities, sinks, coffee tables, lighting and accessories. “Services” means installation services where separately agreed in writing. “Order” means your request to purchase Goods and/or Services. “Contract” means the legally binding agreement formed when we issue written Order Confirmation. “You” or “Customer” means the purchaser of Goods and/or Services.
2. Contract Formation
An Order constitutes an offer to purchase. A binding Contract is formed only when we issue written Order Confirmation. We reserve the right to refuse any Order.
3. Product-Only Supply
Unless expressly agreed in writing, Haus of Marble supplies Goods only. We are not responsible for installation, structural assessment, internal handling, plumbing, electrical works or contractor coordination unless separately contracted.
4. Pricing and Payment
All prices are quoted in GBP and include VAT unless stated otherwise. Full cleared payment is required before production or dispatch. We reserve the right to cancel or suspend Orders where payment irregularities are suspected. Title to Goods passes only once payment is received in full.
5. Bespoke and Made-to-Order Goods
Many of our products are bespoke or made to order. Once production has commenced, Orders cannot be cancelled or amended. Natural materials may contain variations in tone, veining, texture and movement, which are inherent characteristics and not defects. Dimensional tolerances may also apply.
6. Delivery
Large and heavy Goods may be delivered via specialist heavy-goods courier and offloaded using mechanical lifting equipment such as a Moffett forklift. Delivery is made strictly to the exterior of the property unless otherwise agreed in writing. Couriers do not enter the property, move Goods inside, lift items upstairs, or assist with installation. You are responsible for ensuring adequate vehicle access and sufficient external unloading space. Risk transfers to you upon delivery and signature.
7. Customer Responsibilities
You are solely responsible for measuring access routes, ensuring structural load-bearing suitability, arranging qualified installers, protecting flooring and internal finishes during handling, and coordinating installation timing. Marble products are significantly heavier than synthetic alternatives. We strongly recommend professional structural assessment for installations above ground floor or for wall-mounted pieces. Haus of Marble accepts no liability for structural inadequacy or site conditions.
8. Installation Services
Installation services are provided only where expressly agreed in writing. The scope of works will be detailed in your project agreement. Any works not explicitly included remain your responsibility. Plumbing, gas and electrical works must be carried out by certified professionals.
9. Inspection on Delivery
You must inspect Goods upon delivery. Any visible damage, missing components or defects must be reported within 48 hours with photographic evidence. Failure to notify us within this period may invalidate claims relating to transit damage.
10. Guarantee
Haus of Marble products are covered by a limited guarantee against manufacturing defects in materials or workmanship. This guarantee applies only to structural or material defects present at the time of supply. The guarantee does not cover damage during fitting or installation, accidental or malicious damage, improper handling, incorrect installation, structural movement, inappropriate cleaning products, limescale build-up, corrosion, mould or mildew, general wear and tear, natural ageing or patina, alteration, modification or adaptation, commercial use unless agreed, consequential loss, or removal and reinstallation costs.
Only pH-neutral, stone-safe cleaning products must be used. Damage caused by acidic, abrasive or chemical cleaners voids the guarantee. Original proof of purchase is required for all claims. We reserve the right to inspect the Goods prior to agreeing any remedy. Goods must not be removed, altered or destroyed prior to inspection without our written consent. If inspection confirms no manufacturing defect exists, a call-out or inspection charge may apply.
Where a manufacturing defect is confirmed, we may at our discretion repair the Goods, replace the Goods in part or whole, or provide a suitable alternative. Our obligation is strictly limited to the product itself and does not cover labour, removal, reinstallation, contractor fees or associated costs.
11. Limitation of Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence or fraud. Subject to this, Haus of Marble shall not be liable for indirect or consequential loss, loss of profit or business, delay-related costs, third-party contractor fees, reinstallation costs, structural or access issues, or damage caused during third-party installation. Our total liability under any Contract shall not exceed the total amount paid for the Goods supplied.
12. Returns and Cancellations
Bespoke or made-to-order Goods are non-refundable. Standard goods may be returned within 14 days if unused and in their original packaging. Return costs are the customer’s responsibility. Refunds are issued after inspection of returned Goods.
13. Force Majeure
We are not liable for delays or failure caused by circumstances beyond our reasonable control, including shipping delays, customs, strikes, supply chain disruption or government restrictions.
14. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
